The Freedom of Information (FOI) Act was passed on 30 November 2000. It gives a general right of access to all types of recorded information held by public authorities with full access granted in January 2005. The Act sets out exemptions to that right and places certain obligations on public authorities.

We are not allowed to release any confidential materials under the Freedom of Information Act; however you have “subject access” rights to see your own health records under the Data Protection Act 1998.

They will be able to advise you on the release forms you will need to complete and how to obtain maternity and other records. There may be a charge for this service. Please note that the Trust is only obliged to hold records for the standard time limit under the NHS guidelines (usually 8 years but this is extended to 15 years for clinical trials, and up to 25 for child / maternity records).
As the Trust only covers acute services, you will need to contact Surrey and Borders Partnership NHS Trust for mental health records.
